Welcome to Blinkdrop! These Terms and Conditions ("Terms") govern your use of the Blinkdrop website, mobile applications, and services (collectively, the "Service"), provided by provided by PRANSHU PATEL ("we," "us," or "our").

The Blinkdrop Service

Blinkdrop provides a platform for users to upload, store, share, and transfer digital files ("Content"). You are solely responsible for the Content you upload and share through our Service and for complying with all applicable laws related to that Content.

User Accounts

Account Creation: To access certain features of the Service, you may be required to create an account. You must provide accurate, current, and complete information during the registration process.
Account Responsibility: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
Age Requirement: You must be at least 13 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you are of legal age.

You agree not to misuse the Blinkdrop Service or help anyone else to do so. You agree not to, and will not attempt to, use the Service to:

Upload, share, or transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights. You must not upload or share files unless you have the legal right to do so.
Share or distribute viruses, malware, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature.

Violate the privacy or data protection rights of others.
Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
Attempt to gain unauthorised access to the Service, its related systems, or networks.

We reserve the right to investigate and take appropriate action, including removing Content, suspending or terminating your account, and reporting you to law enforcement authorities if you violate this policy.

Your Content and Permissions

Ownership: You retain full ownership of your Content. We don’t claim any ownership of it. These Terms do not grant us any rights to your Content except for the limited rights that are needed to run the Service.

Responsibility: Blinkdrop is not responsible for the Content that users post and share via the Service. We do not have an obligation to monitor user Content.

The Service is protected by copyright, trademark, and other laws of India and foreign countries. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or use any provided account deletion feature.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimers and Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL provided by PRANSHU PATEL, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORISED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Indemnification

You agree to defend, indemnify and hold harmless provided by PRANSHU PATEL and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to solicitor's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
